Its different in different stares in terms of how much accountability the clerk has. In most places they can say the customer appears to be over 21, sometimes they have to say over 40.
In ohio, minimum wage clerks can and do get prosecuted when they accidentally sell alcohol (and I assume spray paint) to a minor.
